Il diritto di recesso consiste nella facoltà dell'acquirente/consumatore di recedere dagli obblighi del contratto stipulato.

Il diritto di recesso può essere esercitatonei seguenti casi:

· nell'ipotesi di fornitura di beni, il consumatore può recedere entro il termine di dieci giorni lavorativi che decorrono dalla data di consegna della merce, a condizione che tutti gli obblighi informativi siano stati adempiuti da parte del venditore prima della conclusione del contratto. Nell'ipotesi in cui in venditore non abbia adempiuto ai propri obblighi informativi prima della conclusione del contratto, il recesso può essere esercitato dall'acquirente entro i 3 mesi successivi alla conclusione del contratto; se entro 3 mesi dalla conclusione del contratto il venditore provvede a far pervenire al consumatore le suddette informazioni il termine tornerà di nuovo a 10 giorni che decorreranno, questa volta, dal ricevimento delle informazioni stesse;

Entro gli stessi termini, è ammessa la comunicazione del recesso anche a mezzo telegramma, telex, fax e anche email, salvo successiva conferma mediante lettera raccomandata con avviso di ricevimento entro le successive 48 ore.

RESTITUZIONE DELLA MERCE:

La merce deve essere restituita a opera e spese del Cliente entro 10 giorni dalla data della raccomandata. Il rimborso verrà effettuato al netto delle spese di spedizione e soltanto dopo aver verificato l’integrità della merce.
